AgenciART is a digital marketplace for the cultural and creative world designed to connect those who create with those who are looking, enabling users to present profiles, creations, services, opportunities, contacts and interactions.

1. Acceptance and scope

By using AgenciART, the user agrees to comply with these Terms of Use and with applicable law. Accessing or using the platform presupposes that these terms have been read and accepted.

2. Purpose of the platform

AgenciART operates as a connection space for creators, projects, services, companies, schools, municipalities, institutions and other users with a legitimate interest in the cultural and creative world. At this stage, the platform does not process payments between users and does not replace the assessment, validation or negotiation that each party should carry out before entering into any agreement.

3. User account

The user is responsible for the accuracy of the information provided during registration and for the security of their access credentials. Accounts must not be shared with third parties, and false identities or misleading information must not be used.

4. Published content and conduct

Each user is responsible for the content, messages, images, descriptions, contact details and other information they publish or send through AgenciART. Only content compatible with the platform’s cultural and creative scope may be published, including artistic creation, education, technology, innovation, experiences, services and related institutional projects. AgenciART must not be used for spam, fraud, harassment, defamation, copyright infringement, abusive data collection, unlawful content or any conduct that harms other users or the platform itself.

5. Intellectual property and content rights

The user declares that they hold the necessary rights to the content they publish or are duly authorised to use it. Publishing content on AgenciART does not transfer ownership of those rights to the platform. However, the user grants AgenciART a non-exclusive authorisation, limited to operating, promoting and presenting the platform, to display that content within the service.

6. Moderation and platform management

AgenciART may, at any time and without prior notice, remove, hide, technically edit, suspend or limit content, accounts or uses it considers inappropriate, abusive, illegal, misleading or contrary to these terms, and may adopt measures to protect the platform and its community.

7. Personal data protection and GDPR

AgenciART processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable national law. Personal data is processed according to principles of lawfulness, fairness, transparency, minimisation, purpose limitation, accuracy, security and retention only for as long as necessary for the relevant purpose. Depending on how the platform is used, data such as name, email, account data, messages, technical access records, published content and elements necessary for security, support and service improvement may be processed. For aggregated usage and security statistics, the server may estimate country, region and city from the IP address at the time of access; for this statistical purpose, AgenciART does not record the raw IP address, coordinates, postal code or GPS location. Under applicable law, users may exercise their rights of access, rectification, erasure, restriction, objection and other legally recognised rights through the contact channels provided by the platform.

8. Logs, security and abuse prevention

For security, technical support, activity logging, abuse prevention, service improvement and operational analysis, AgenciART may record technical events associated with use of the platform, including pages accessed, interactions with the virtual assistant, IP address, browser agent, date and time, access source and other elements strictly necessary to operate and protect the service.

9. Service availability

AgenciART seeks to keep the platform available and up to date, but does not guarantee continuous operation, absence of errors, absolute compatibility with every device or uninterrupted availability. Changes, interruptions, maintenance, functional evolution or technical adjustments may occur at any time.

10. Limitation of liability

AgenciART does not guarantee contracts, business deals, invitations, replies, opportunities or outcomes between users. The platform facilitates discovery and connection, but contacts, agreements, validations, travel, payments, permissions and other relationships between users remain the sole responsibility of the parties involved.

11. Changes to these terms

AgenciART may update these Terms of Use whenever necessary to reflect legal, technical, functional or operational changes. The most recent version is the version published on the platform.
